Gemini Inflatables Warranty
( 5 Y E A R L I M I T E D W A R R A N T Y - Recreational Use Only)
COVERAGE
GEMINI INFLATABLES Pty Ltd makes the following warranties to the original consumer purchaser of Gemini Inflatable Craft for recreational use only:
- Warrants the seams of the GEMINI Inflatable tube for a period of two (2) years from the date of original purchase against separation and subsequent loss of air.
- Warrants the fabric used in the construction of the Tube, keel (where installed) and bottom of the Inflatable Boat against defects in workmanship and materials for a period of five(5) years from date of original purchase.
- Warrants the transom and hull of all GEMINI Inflatable Boats against separation from the hull for a period of one (1) years from the date of original purchase. However, this warranty is cancelled if an outboard motor is used in excess to power or propel the boat greater than the maximum horsepower stamped on the compliance plate attached to the transom.
- Warrants the transom and hull of all GEMINI Inflatable Boats against separation from the hull for a period of one (1) years from the date of original purchase. However, this warranty is cancelled if an outboard motor used in excess of weight restrictions in regards to 4 stroke outboards.
- Floorboards, handles, towing rings and all other GEMINI attachments or GEMINI accessories attached to or purchased for attachment to or use on GEMINI Inflatable Boats are warranted for a period of one year from the date of original purchase against defects in workmanship and material.
If, within the warranty periods set forth above, your new Inflatable Boat is proved to GEMINI INFLATABLES Pty Ltd satisfaction to be defective, non-conforming parts will be repaired without charges for parts or labour, or replaced, at GEMINI INFLATABLES' option.
Other Limitations or Exclusions
- This warranty coverage is extended only to the original purchaser, and this warranty may not be transferred or assigned.
- This warranty shall not apply to Inflatable Boats subjected to negligence, accident, improper operation or trailering, improper maintenance or storage, or other than normal use or application, as described in .the Gemini Operations Manual or to damage by circumstances beyond GEMINI's or GEMINI INFLATABLES's control.
- This warranty does not cover damage to the Inflatable Boat because of puncture, tearing, ripping, abrasion, ordinary wear and tear, abuse, negligence or modification to the hull, over inflation or racing, or boats designed for racing.
- PVC hulls are not to be stored in direct sunlight or under a heat absorbing cover.
- GEMINI AND GEMINI INFLATABLES LIMIT ALL IMPLIED WARRANTIES TO ONE (1) YEAR FROM THE DATE THAT THE BOAT WAS ORIGINALLY PURCHASED BY THE END USER.
(Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply.)
- This warranty does not apply to Gemini craft used for commercial applications. Commercial warranty conditions will be verified once the use of the boat is known
NEITHER GEMINI OR GEMINI INFLATABLES SHALL IN ANY EVENT BE LIABLE FOR DEATH, INJURIES TO PERSONS OR PROPERTY OR FOR INCIDENTAL, CONTINGENT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF OUR BOATS.
Warranty Claims Procedure
All warranty claims must be made within thirty (30) days after discovery of a defect and submitted on the GEMINI warranty claim form available from the dealer together with proof of purchase. Photographs illustrating damage, if any, should accompany the claim. An authorized representative may make an inspection, within a reasonable time, after receipt of the claim.
When a warranty claim is valid GEMINI will repair, have repaired, or at its option, replace the Inflatable Boat or defective part free of charge. Freight and transportation charges, where applicable, incurred in shipping a boat to be repaired or replaced are to be paid by consumer purchaser.
Other Important Information
- Gemini and GEMINI INFLATABLES Pty Ltd reserve the right to make changes in the design and material of its Inflatable Boats without incurring any obligations to incorporate such changes in units already complete or in the hands of dealers, consumers of Surf Clubs.
- The entire obligation of GEMINI and GEMINI INFLATABLES regarding the sale of GEMINI Inflatable Boats is stated within this written warranty. GEMINI and GEMINI INFLATABLES does not authorise its' dealers or any other person to assume for it any other liability in connection with the sale of its Inflatable Boats.
- The warranties herein before set forth are made to you by the manufacturer, GEMINI Inflatable Craft. If for any reason you are unable to locate a Gemini dealer or if the dealer does not provide satisfactory warranty service, contact GEMINI INFLATABLES Pty Ltd, Shop 7 Gold Coast City Mariner, Waterway Drive, Coomera QLD 4209 AUSTRALIA.
